Foyen authors updates on construction law and project financing

Getting the Deal Through is an international publication covering 75 business areas linked to more than 150 jurisdictions and collaborating with many of the world’s leading law firms. The different sections are written by experts in each area, and we at Foyen are proud to represent Sweden with our latest contributions regarding the construction law and project financing areas in Construction 2018 and Project Finance 2018.

Construction 2018 reviews the legislation in the construction sector in 26 countries. Foyen partners Jacob Hamilton, Richard Sahlberg and Per Vestman explain what applies with respect to construction law in Sweden.

“An important part of the Swedish section in Getting the Deal Through Construction is the annual news update regarding Swedish construction law. Even though it is an international publication, we also have domestic clients who request the annual edition. We get a sense that our contribution with these updates is of particular importance since we hear that corporate lawyers in Sweden share the edition with corporate lawyers in other countries as an initial source concerning how issues are handled in Sweden”, says Richard Sahlberg, one of the authors of the Swedish section on construction law.

Project Finance 2018 offers a quick overview of the relevant legislation with respect to project financing in 36 countries. Foyen partners Peter Dyer and Andreas Lindström explain the Swedish legal rules for project financing, among other means, by answering questions regarding how a project company is organised, how assets can be packaged as security for lenders in the best possible manner, whether there are any restrictions on foreign investors, and what the relevant public authorities are in conjunction with infrastructure projects.

How are public procurement contracts affected by the EU’s decision on sanctions against Russia?

During the spring of 2022, the EU decided on a series of sanctions against Russia in response to Russia's invasion of Ukraine. On 8th of April 2022, the EU decided on a fifth package of sanctions which includes, among other things, further restrictions on trade with Russia. One element of this is the extension of the list of controlled items which might contribute to Russia’s military and technological enhancements or the development of its defence and security sector, and restrictions have been imposed regarding goods for import and export, transactions, and financing and financial assistance, among others. In the context of these sanctions, the Regulation also introduces a new article that addresses public procurement contracts.
